By downloading, installing, or using the InstaCaption app ("App") developed by Quadosoft, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
InstaCaption is provided solely for personal, non-commercial use. You may use the App to upload images and receive AI-generated captions. You agree not to misuse the App or violate any applicable laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms. All rights not expressly granted to you are reserved by Quadosoft.
Certain features of the App require a paid subscription. Subscription plans are offered on a monthly and yearly basis and are provided as in-app purchases through the Google Play Store.
Billing and Payment Processing: All payments for in-app purchases and subscriptions are processed securely through Google Play Billing. By purchasing a subscription you agree to Google Play’s purchase terms and to any billing agreements that may apply. Quadosoft does not directly process or store your payment card details.
RevenueCat: We use RevenueCat as a subscription management library and service to implement and manage subscriptions, validate receipts, determine entitlements, and synchronize subscription status across devices. RevenueCat may receive non-personal purchase information such as purchase tokens, product identifiers, transaction identifiers, and subscription status. RevenueCat acts as a data processor for these purposes and does not receive your full payment card details.
Anonymous App User IDs: InstaCaption uses only RevenueCat’s anonymous App User IDs to map subscription entitlements and sync status across devices. We do not set or use custom or personally-identifying App User IDs via RevenueCat.
Auto-renewal: Subscriptions (monthly and yearly) typically auto-renew at the end of each billing period until cancelled. You authorize Google Play to charge you for any renewal period unless you cancel before the renewal date.
Price changes & notifications: Google Play or Quadosoft may change subscription pricing. Google Play will notify you of any price changes and provide you the choice to accept the new price or cancel the subscription prior to renewal.
Managing and Cancelling Subscriptions: You can manage, update, pause, or cancel your subscription at any time through your Google Play account (Play Store → Subscriptions). Cancelling a subscription will stop future renewals; you may retain access to paid features until the end of the current billing period.
Refunds: Refund requests are handled by Google Play in accordance with Google Play’s refund policies. To request a refund, please use Google Play’s refund process. While Quadosoft does not control Google Play’s refund decisions, you may contact us for support and we will assist where possible.
Subscription Disputes and Chargebacks: If you believe a charge was made in error or you did not authorize a purchase, you should first contact Google Play support. We may require purchase receipts or other proof of purchase to help resolve disputes.
Third-Party Terms: All purchases are subject to Google Play’s terms of sale and policies. By purchasing within the App you agree to those terms in addition to these Terms.
You may upload images to generate captions. These images are temporarily processed and are not stored by us after processing. You retain all rights to your uploaded content, but you grant Quadosoft a temporary license to use the content solely to provide the App’s functionality.
To ensure fair and reliable performance for all users, we may implement automated limits to detect and prevent unusual or excessive usage that may indicate abuse (e.g., spamming or automated image uploads).
These limits are designed to safeguard system integrity and are not intended to affect normal, everyday use by regular users. If you are a genuine user encountering unexpected restrictions, please contact us and we’ll be happy to help.
All content within the App, including text, graphics, logos, and the App’s design, is the exclusive property of Quadosoft and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or use any part of this content without prior written permission.
However, the AI-generated captions created based on your uploaded images are your property. You are free to use, modify, share, and distribute these captions without restriction.
We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including if you violate these Terms. Upon termination, your right to use the App will immediately cease.
Quadosoft may update or modify the App or these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
You agree to indemnify, defend, and hold harmless Quadosoft, its affiliates, and its employees from any claims, damages, losses, or liabilities arising from your use of the App or violation of these Terms.
The App is provided "as is" and "as available", without warranties of any kind, either express or implied. To the fullest extent permitted by law, Quadosoft disclaims all liability for damages arising out of your use or inability to use the App.
These Terms are governed by the laws of your jurisdiction, without regard to conflict of law principles.
